1. Information We Collect

We collect information to provide and improve our services. The data we collect may include:

• Account Information: Username, email address, and password when creating an account.
• Payment Details: Card data is collected via NMI's hosted inline tokenization (Collect.js). Your card details go directly to NMI and are tokenized at the point of entry — BlackGuard never receives, stores, or accesses raw card numbers, CVVs, or banking credentials. BlackGuard receives only a single-use payment token, transaction status, and order metadata (e.g., order ID, plan type, payment status). NMI operates as a PCI DSS Level 1 payment gateway; BlackGuard's card-data scope is limited to SAQ-A under PCI DSS.
• Device Information: Hardware identifiers (HWID, system ID, IP address, OS version) to enforce license protection and prevent unauthorised sharing.
• Usage Data: Logs of access times, error events, and anonymised analytics to improve performance and stability.
• Anti-Cheat Imagery: When a player is flagged by BlackGuard's behavioural analysis, the anti-cheat system may capture screenshots of the game window/render to detect unauthorised visual tools or performance-assist software. These screenshots capture only the game render — never the player's desktop, other applications, browser windows, or personal files. Images are processed by automated systems, retained for a maximum of 14 days, then permanently deleted. See Section 11 for full details.

2. How We Use Your Information

Your data is used only for legitimate business and service-related purposes, including:

• Providing and managing software licenses.
• Verifying user identity and preventing fraud.
• Facilitating payment processing through NMI and CoastalPay.
• Processing refund requests in accordance with our Refund Policy.
• Improving our website, products, and user experience.
• Complying with legal and regulatory obligations.

3. Data Storage and Security

We take security seriously. All stored data is protected through encryption, secure servers, and restricted access. Hardware and software identifiers are hashed or encrypted before transmission.

We use trusted service providers including Supabase (database and authentication) and NMI/CoastalPay (payment processing). NMI is a PCI DSS Level 1 certified payment gateway. All connections use SSL/TLS encryption; stored data is protected with AES-256 encryption.

4. Sharing of Information

Real Dudes LLC does not sell or trade your personal data. We may share limited data with trusted third parties only when necessary:

• NMI / CoastalPay (payment gateway and processor) — card tokenization and payment processing are handled by NMI (gateway) and CoastalPay (acquirer). NMI receives tokenized card data directly via Collect.js; BlackGuard receives only transaction outcome and order metadata for license fulfillment and refund processing. Real Dudes LLC is the merchant of record.
• Analytics providers — anonymised data for site performance and service optimisation (e.g., Google Analytics).
• Legal authorities — if required by law or to protect against fraud or misuse.

5. Cookies and Tracking

We use cookies and similar technologies to maintain login sessions, remember preferences, and analyse website performance. Payment tokenization fields served via NMI's Collect.js may operate in an isolated iframe context. You can disable cookies in your browser settings, but some features may not function correctly without them.

6. Data Retention

We retain user data only for as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. Transaction records may be retained for the period required by applicable tax and financial regulations. You may request data deletion by contacting us directly.

Anti-cheat game-render screenshots captured during a detection event are retained for a maximum of 14 days from the date of capture, after which they are permanently deleted. Screenshots are not retained beyond this window unless specifically required by an active legal or enforcement dispute notified to us within that period.

7. Your Rights

Depending on your location, you may have the right to:

• Access the personal data we hold about you.
• Request corrections or deletion of your information.
• Withdraw consent for non-essential data processing.
• Request export of your data in a structured, machine-readable format.
• Exercise statutory consumer rights (including refund and withdrawal rights) as described in our Refund Policy. Real Dudes LLC is the merchant of record and is responsible for processing refunds in accordance with that policy.

8. Third-Party Services

Our platform integrates with the following third-party services, each operating under their own privacy policies:

• NMI (Network Merchants Inc.) / CoastalPay — payment gateway and processor. NMI handles card tokenization (Collect.js) and is a PCI DSS Level 1 certified gateway. BlackGuard never receives or stores raw card data.
• Supabase — database and authentication infrastructure. Data is stored in encrypted, access-controlled environments.
• Google Analytics — anonymised website usage analytics. Governed by Google's Privacy Policy.

Real Dudes LLC is not responsible for the privacy practices of these third parties. We encourage you to review their respective policies.

9. Data Transfers

Real Dudes LLC operates globally, and your data may be processed on servers located in other countries. Payment processing data is handled by NMI and CoastalPay in accordance with their own data transfer and security practices. We ensure all data transfers by BlackGuard comply with applicable privacy laws including GDPR where relevant.

10. Children's Privacy

BlackGuard does not knowingly collect or store information from anyone under the age of 16. If we become aware that such data has been collected, it will be deleted immediately. Parents or guardians who believe their child has provided information to us should contact support@blackguardac.com.

11. Automated Decision-Making and Anti-Cheat Detection

BlackGuard uses automated systems to analyse in-game behaviour and detect activity that violates server rules (such as the use of unauthorised visual tools or performance-assist software). These systems process technical data — including gameplay telemetry, hardware identifiers, and behavioural patterns — to generate detection signals.

Game-render screenshot capture: When a player is flagged by BlackGuard's behavioural analysis, the anti-cheat system may capture screenshots of the game window or render output to detect unauthorised visual tools or performance-assist software. These screenshots capture only the game render — they never capture the player's desktop environment, other open applications, browser windows, personal files, or any content outside the game window. Screenshots are processed by automated systems only. They are retained for a maximum of 14 days from the date of capture and then permanently deleted. No screenshot is shared externally except where required by applicable law.

Detection results — including any supporting imagery — are surfaced to the server operator (your game server administrator), who makes the final decision on any action taken against a player account (such as a ban or restriction). BlackGuard does not issue bans directly to end-users; all enforcement decisions are made by the server operator, not solely by automated means.

If you believe a detection decision was made in error, you should contact the administrator of the game server where the restriction was applied. Under GDPR Article 22, you have the right not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects — that right is preserved here by the operator review step.

12. Updates to This Policy

Real Dudes LLC may update this Privacy Policy periodically. Updates will be posted on this page with a revised date. Continued use of our services after any update constitutes acceptance of the revised policy.
