Terms of Service

1. Acceptance of Terms

By accessing or using BlackGuard, operated by Real Dudes LLC, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. You must be of legal age in your country to enter into this agreement. If you do not agree, do not use our Services.

2. Account Registration and Security

You agree to provide accurate, current, and complete information when creating an account or purchasing a license. You are responsible for keeping your login credentials and license keys secure. Sharing, reselling, or distributing your account or license key is strictly prohibited and may result in permanent termination without refund.

3. User Conduct and Prohibited Activities

You agree not to engage in any of the following:

• Use the Services for illegal or malicious purposes.
• Reverse engineer, decompile, or tamper with our software, executables, or backend systems.
• Attempt to bypass our licensing, integrity, or security systems.
• Use debugging or reverse engineering tools such as dnSpy, x64dbg, x32dbg, IDA, OllyDbg, Wireshark, Cheat Engine, or similar.
• Distribute viruses, malware, or harmful scripts through or in connection with our software.
• Impersonate BlackGuard staff, partners, or affiliates, or misuse our branding.

4. Payment and Refund Policy

Payments for BlackGuard subscriptions are processed by NMI (payment gateway) and CoastalPay (processor/acquirer). Real Dudes LLC is the merchant of record for all transactions. Card data is collected via NMI's hosted inline tokenization (Collect.js) and goes directly to NMI — BlackGuard never receives or stores raw card details.

Our refund terms, including eligibility windows and how to submit a request, are set out in our Refund Policy. If a chargeback or payment dispute is initiated, the associated license may be suspended while the case is under review. We encourage customers to contact support@blackguardac.com before escalating to a payment provider.

5. License and Device Policy

Each BlackGuard license is locked to a single device through hardware identification (HWID). Transferring, reselling, or using the license on multiple devices is not allowed. If you reinstall Windows or make significant hardware changes, you may request a reset if eligible.

Reset requests are only accepted if:

• Your OS was reinstalled within the last 7 days.
• No previous reset was done within that period.
• The change was unintentional (e.g., system failure, OS corruption).

Requests will not be approved for transferring licenses, using a new device, or personal preference.

6. Account Suspension or Termination

We reserve the right to suspend or terminate any account or license for violations of these Terms, chargebacks, unauthorized sharing, or security breaches. Suspensions and bans are final and non-negotiable.

7. Intellectual Property

All software, designs, code, and content within BlackGuard are the intellectual property of Real Dudes LLC or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of our software or website. Unauthorized use may lead to legal action.

8. Limitation of Liability

BlackGuard is provided "as is" and "as available." We do not guarantee uninterrupted service or compatibility with all systems. To the maximum extent allowed by law, Real Dudes LLC shall not be held liable for any indirect, incidental, or consequential damages, including loss of data, revenue, or reputation.

9. Anti-Cheat Scope and Screenshot Capture

By connecting to a game server running BlackGuard, players acknowledge that the BlackGuard anti-cheat system may perform the following as part of its detection operations:

• Analyse gameplay telemetry, hardware identifiers, and behavioural patterns for detection signals.
• Capture screenshots of the game window or render output when a player is flagged by behavioural analysis, for the purpose of detecting unauthorised visual tools or performance-assist software. These screenshots capture only the game render — never the player's desktop, other applications, browser windows, or personal files. Images are processed by automated systems, retained for a maximum of 14 days, then permanently deleted.

Server operators deploying BlackGuard are responsible for informing players on their server that these monitoring activities are in operation, including the possibility of game-render screenshot capture. All enforcement decisions remain with the server operator; BlackGuard does not issue bans directly.

10. Modifications to Terms

Real Dudes LLC reserves the right to modify these Terms at any time. Updated Terms will be posted on our website, and continued use of our Services constitutes acceptance of the new Terms.

11. Governing Law

These Terms are issued by Real Dudes LLC and governed by the laws of England and Wales. Any disputes shall be handled exclusively in the courts of England and Wales, without prejudice to any mandatory consumer protection rights applicable in your country of residence.
